Terms of Service

These Terms of Service ("Terms") form an agreement between you and Filip Brády, who operates LeadScouter. LeadScouter (leadscouter.app) is operated by Filip Brády, a sole trader established in Slovakia, European Union. Registered business address: Čergovská 7258/24, 080 01 Prešov, Slovakia. Registered in the Trade Register of the District Office Prešov (Okresný úrad Prešov). Company ID (IČO): 55584268. Tax ID (DIČ): 1082754090. VAT ID (IČ DPH): SK1082754090, registered under §7a of the Slovak VAT Act (Act No. 222/2004 Coll.) for cross-border services only; not a VAT payer for domestic supplies.

By creating an account or using LeadScouter you agree to these Terms and confirm that you have read our Privacy Policy and Cookie Policy. If you use LeadScouter on behalf of a company or other organisation, you confirm that you are authorised to accept these Terms for it, and "you" includes that organisation.

LeadScouter lets you search for local businesses by niche and location, preview them, and run audits that combine data from Google Places, the business's public website, Google PageSpeed Insights and AI-generated analysis. You can save leads to lists, add notes and tags, export data, and create read-only links to share reports.

We continuously develop the service. Features, limits and integrations may change over time as described in section 14.

LeadScouter is offered only to businesses, agencies and freelancers acting for their trade, business or profession. By registering you confirm that you are at least 18 years old, able to enter into a binding contract, and not acting as a consumer. We do not conclude contracts with consumers; section 7 explains what applies if the law nevertheless treats you as one.

Give accurate information when you register and keep your email address up to date. You need to verify your email before you can use the service.

Keep your password confidential and do not share your account. You are responsible for activity under your account. Tell us at privacy@leadscouter.app straight away if you suspect unauthorised access.

Paid plans are subscriptions billed in advance through Stripe, monthly or annually, in the currency you choose at checkout. Prices and the number of credits included in each plan are shown on the pricing page and at checkout, together with any taxes that apply.

Monthly plans add the plan's monthly credits to your balance at the start of each billing month. Annual plans add twelve months of credits at the start of the annual term. Searching and previewing businesses is free where the app says so. Running an audit costs credits; the app shows the cost before you start.

When you start an audit, its credits are reserved. They are spent when the audit completes. If the audit fails or does not run, the reserved credits are released back to your balance automatically.

Top-ups are one-off purchases that add credits to your balance without changing your plan.

Credits have no cash value, cannot be transferred or exchanged for money, and can only be used in LeadScouter. Credits do not currently expire while your account is open. If we introduce an expiry period, it will apply only to credits granted after we have given you at least 30 days' notice.

If a payment is refunded or reversed (for example through a chargeback), the unspent credits granted by that payment are removed from your balance.

We may change prices or plan contents. For subscriptions we will tell you at least 30 days before the change applies to your next billing period, so you can cancel first if you do not agree.

Subscriptions renew automatically for the same billing period (one month or one year) at the then-current price until you cancel. Before an annual plan renews, we email you the renewal date and price at least 30 days in advance. You can cancel at any time from the Billing page, which opens the Stripe customer portal. Cancellation stops the next renewal and takes effect at the end of the current paid term; you keep access to paid features until then.

If a renewal payment fails, Stripe will retry it and we may limit paid features until the payment succeeds.

Except where these Terms or the law say otherwise, payments are non-refundable: we do not refund spent credits, partial billing periods or unused credits. This does not affect your statutory rights. If you believe you were charged in error, contact us and we will look into it.

Credits already granted stay in your balance after a subscription ends, for as long as your account remains open. If you close your account, unspent credits lapse without refund, except where the law requires one.

LeadScouter is a business service and is not sold to consumers (see section 3). If mandatory law nevertheless treats you as a consumer, nothing in these Terms limits the rights you have under that law, including the right of withdrawal and your rights if the service is not supplied as agreed. Contact us and we will apply them.

If we do not resolve a complaint, a consumer may submit it to an alternative dispute resolution body, in particular the Slovak Trade Inspection (Slovenská obchodná inšpekcia, Bajkalská 21/A, 827 99 Bratislava, www.soi.sk), or another body listed by the Ministry of Economy of the Slovak Republic.

Use LeadScouter only lawfully and in good faith. In particular, you must not:

• send spam or unsolicited bulk messages, or contact businesses in breach of the GDPR, ePrivacy or anti-spam rules that apply to you or the recipient. You alone are responsible for your outreach: having a legal basis, identifying yourself, telling people at first contact where you obtained their data and how to object (Art. 14 GDPR), honouring opt-outs and objections, and following the rules of the channels you use;
• harass, mislead or defame businesses, or present audit results as an official certification, a guarantee, or the work of the business or of Google;
• resell, publish or redistribute data from LeadScouter in bulk, or build a competing database from it; data from Google Maps Platform is also subject to Google's terms, which prohibit extracting it outside the product;
• access the service with bots, scrapers or other automated means except through features we provide, or circumvent credits, rate limits, access controls or other technical limits;
• probe, scan or test the security of LeadScouter or of audited websites without permission, or use LeadScouter to attack, overload or interfere with any website or system;
• store unlawful content, or special categories of personal data, in notes, tags or lists.

We may suspend or limit accounts that break these rules (see section 15).

Search results and audits are based on data from third parties and public sources, including Google Places, the websites of the businesses themselves and Google PageSpeed Insights. This data can be incomplete, out of date or wrong, and it changes over time. We do not verify it and cannot guarantee its accuracy.

Audit summaries, findings explanations, pitch suggestions, copy rewrite suggestions and draft email and call openers are generated automatically, partly with AI. They can contain errors, omissions or statements that sound more certain than the underlying data supports.

Review AI output before you rely on it or send it to anyone. You are responsible for the messages and materials you send to prospects. LeadScouter does not guarantee leads, sales, rankings or any business result.

You can create a read-only link to an audit report to send to a prospect. Anyone who has the link can view the report without signing in. Shared pages are marked so that search engines do not index them, and they do not show your account details.

You decide who receives a link and you are responsible for sharing it appropriately. You can revoke a link at any time; creating a new link for the same report replaces the old one.

Shared reports contain information about the business concerned, including contact details it publishes. Sales-internal parts (pitch angle, outreach drafts, your notes and pipeline status) are never included. We record how many times a link was opened and when it was last opened, and show this to you; we do not identify individual viewers.

Notes, tags, lists and other content you add remain yours. You give us a non-exclusive licence to host, store and process that content only as needed to provide and secure the service.

You may use the reports and exports you generate for your own business purposes, including sharing them with the businesses concerned, in line with these Terms. Exports are generated when you download them; once downloaded they are under your control, and you are responsible for storing them securely, using them lawfully and deleting them when no longer needed.

Data processing terms (Art. 28 GDPR). For personal data you add to LeadScouter (notes, tags, pipeline status, lists and the exports you create), you are the controller and we process that data on your behalf as your processor. We process it only on your documented instructions, which are these Terms and your use of the features; keep it confidential and ensure that people with access are bound to confidentiality; protect it with the security measures described in our Privacy Policy; use only the sub-processors listed there, telling you about changes so you can object; help you respond to data subject requests and personal data breaches; delete or return it when your account closes, except where the law requires us to keep it; and on request provide the information needed to demonstrate compliance with Art. 28 GDPR. These provisions form the data processing agreement between you and us.

LeadScouter, including its software, design, report templates and scoring methods, belongs to us or our licensors. Apart from the right to use the service under these Terms, we do not grant you any rights in it. Do not copy, modify, reverse engineer or resell the service except where the law expressly allows it.

If you send us feedback or suggestions, we may use them without obligation to you.

We aim to keep LeadScouter available and working well, but we do not guarantee uninterrupted or error-free operation and we do not offer a service level agreement. The service may be unavailable during maintenance, because of provider outages or for reasons outside our control.

We may add, change or remove features. If a change materially reduces what you pay for, we will tell you in advance, and you may cancel your subscription.

You may stop using LeadScouter at any time. To close your account, cancel any subscription in Billing and email privacy@leadscouter.app; we then delete your data as described in the Privacy Policy.

We may suspend or close your account, with notice where reasonable, if you seriously or repeatedly breach these Terms, do not pay, or use the service in a way that creates legal or security risk. If we close your account for a serious breach, unspent credits lapse. If we stop providing the service or close your account without cause, we will refund the unused part of any prepaid subscription period.

Sections that by their nature should continue after termination (including those on liability, intellectual property and governing law) continue to apply.

To the extent permitted by law, LeadScouter is provided "as is" and "as available", without warranties of any kind beyond those that cannot be excluded by law.

To the extent permitted by law, we are not liable for indirect or consequential loss, lost profits, lost revenue, lost business opportunities or lost data, and our total liability arising from or in connection with these Terms in any 12-month period is limited to the amount you paid us in that period.

These limits do not apply to liability for intentional misconduct or gross negligence, for death or personal injury, or to any other liability that cannot be limited or excluded under applicable law. If you are a consumer, they do not limit your mandatory statutory rights.

If you use LeadScouter as a business, you will compensate us for third-party claims, losses and reasonable costs arising from your outreach or from your breach of these Terms.

These Terms are governed by the laws of the Slovak Republic, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Disputes with business customers are decided by the competent courts of the Slovak Republic.

If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in the courts of that country.

We may update these Terms when the service or the law changes. For material changes we will give you at least 30 days' notice by email or in the app. If you do not agree, you can cancel before the change takes effect; if you keep using LeadScouter afterwards, the updated Terms apply.

These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and us about LeadScouter. If a provision is found invalid, the rest remains in force. If we do not enforce a right straight away, we do not waive it. We may transfer this agreement to a successor operating LeadScouter; we will tell you if that happens. These Terms are written in English, and the English version is the binding one.

To report illegal content, including a shared report, email us the link and explain why; we review reports promptly and tell you what we decided.
